Terms of Service

By accessing or using the Athena CMMC Omniverse™ platform provided by Athena Consulting Group ("ACG," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

The Athena CMMC Omniverse™ is a defense-grade compliance platform designed for C3PAOs and Defense Industrial Base (DIB) contractors. Our services include:

• Automated CMMC compliance assessments
• Interview, Examine, and Test methodology implementation
• Evidence management and secure storage
• Compliance reporting and certification support
• Partner integration capabilities

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Violate any laws, including export control regulations
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any systems
• Upload malicious code, viruses, or harmful content
• Misrepresent your identity or affiliation
• Share or distribute controlled unclassified information (CUI) improperly

We implement security measures aligned with NIST 800-171, DFARS 252.204-7012, and CMMC requirements. However, you acknowledge that:

• No system is completely secure
• You are responsible for proper classification and handling of CUI
• You must comply with all applicable security requirements
• You should maintain appropriate backups of critical data

Certain features may require payment. You agree to pay all fees associated with your selected plan. Fees are non-refundable except as required by law. We reserve the right to modify pricing with reasonable notice.

While we strive for high availability, we do not guarantee uninterrupted service. We may suspend or terminate service for maintenance, updates, or other operational needs. We are not liable for any loss resulting from service interruptions.

Our platform may integrate with third-party services. We are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party integrations is subject to their respective terms and conditions.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE CMMC CERTIFICATION OR COMPLIANCE OUTCOMES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

You agree to indemnify and hold harmless ACG from any claims, damages, losses, liabilities, and expenses arising from your use of the service, violation of these terms, or infringement of any rights.

We may terminate or suspend your account at any time for violations of these terms or for any reason with notice. Upon termination, your right to use the service ceases immediately. You may terminate your account at any time through your account settings.

These Terms shall be governed by and construed in accordance with the laws of the United States and the applicable state jurisdiction, without regard to conflict of law provisions.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance of the modified terms.
